Les présentes conditions de vente sont conclues d’une part par la société Carco Watercolor, société individuelle dont le siège social est situé à Chaville, immatriculée au Registre du Commerce et des Sociétés de Nanterre sous le numéro 914 908 025 RCS ci-après dénommée le « VENDEUR » et gérant le site carco-watercolor.com et, d’autre part, par toute personne physique ou morale souhaitant procéder à un achat via le site internet carco-watercolor.com dénommée ci-après " l’acheteur ".

Article 1. Objet

Les présentes conditions de vente visent à définir les relations contractuelles entre le VENDEUR et l’acheteur et les conditions applicables à tout achat effectué par le biais du site internet carco-watercolor.com. L’acquisition d’un produit à travers le présent site implique une acceptation sans réserve par l’acheteur des présentes conditions de vente dont l’acheteur reconnaît avoir pris connaissance préalablement à sa commande. Avant toute transaction, l’acheteur déclare d’une part que l’achat de produits sur le site carco-watercolor.com est sans rapport direct avec son activité professionnelle et est limité à une utilisation strictement personnelle et d’autre part avoir la pleine capacité juridique, lui permettant de s’engager au titre des présentes conditions générales de ventes.

Le VENDEUR conserve la possibilité de modifier à tout moment ces conditions de ventes, afin de respecter toute nouvelle réglementation ou dans le but d'améliorer l’utilisation de son site. De ce fait, les conditions applicables seront celles en vigueur à la date de la commande par l’acheteur.

Article 2. Produits

Les produits proposés sont ceux qui figurent sur le site carco-watercolor.com de la société Carco Watercolor. Le VENDEUR se réserve le droit de modifier à tout moment l’assortiment de produits. Chaque produit est présenté sur le site internet sous forme d’un descriptif reprenant ses principales caractéristiques techniques (contenance, utilisation, composition…). Les photographies sont les plus fidèles possibles mais n’engagent en rien le Vendeur. La vente des produits présentés dans le site carco-watercolor.com est destinée à tous les acheteurs résidants dans les pays qui autorisent pleinement l’entrée sur leur territoire de ces produits.

Article 3. Tarifs

Les prix figurant sur les fiches produits du catalogue internet et sont des prix en Euros (€) toutes taxes comprises (TTC) tenant compte de la TVA applicable au jour de la commande. Tout changement du taux de la TVA pourra être répercuté sur le prix des produits. Le VENDEUR se réserve le droit de modifier ses prix à tout moment, étant toutefois entendu que le prix figurant au catalogue le jour de la commande sera le seul applicable à l’acheteur. Les prix indiqués ne comprennent pas les frais de livraison, facturés en supplément du prix des produits achetés suivant le montant total de la commande.

Article 4. Commande et modalités de paiement

Avant toute commande, l’acheteur doit créer un compte sur le site carco-watercolor.com. La rubrique de création de compte est accessible directement depuis la barre de menu latérale. A chaque visite, l’acheteur, s’il souhaite commander ou consulter son compte (état des commandes, profil…), devra s’identifier à l’aide de ces informations. La société carco-watercolor.com propose à l’acheteur de commander et régler ses produits en plusieurs étapes, de la manière suivante :

- Paiement sécurisé par Paypal ou carte bancaire : l’acheteur sélectionne les produits qu’il souhaite commander dans le « panier », modifie si besoin (quantités, références…), vérifie l’adresse de livraison ou en renseigne une nouvelle. Puis, les frais de port sont calculés et soumis à l’acheteur. Ensuite, l’acheteur choisit le mode de paiement de son choix : « Paiement par Paypal » ou « paiement par carte bancaire». L’étape suivante lui propose de  renseigner et vérifier l’ensemble des informations, prendre connaissance et accepter les présentes conditions générales de vente en cochant la case correspondante, puis l’invite à valider sa commande en cliquant sur le bouton « Confirmer ma commande ». Enfin, l’acheteur est redirigé sur l’interface sécurisée PAYPAL afin de renseigner en toute sécurité ses références de compte Paypal, ou sur l’inteface sécurisée de sa carte bancaire personnelle. Si le paiement est accepté, la commande est enregistrée et le contrat définitivement formé. Le paiement par compte Paypal ou par carte bancaire est irrévocable. En cas d’utilisation frauduleuse de celle-ci, l’acheteur pourra exiger l’annulation du paiement par carte, les sommes versées seront alors recréditées ou restituées. La responsabilité du titulaire d’une carte bancaire n’est pas engagée si le paiement contesté a été prouvé effectué frauduleusement, à distance, sans utilisation physique de sa carte. Pour obtenir le remboursement du débit frauduleux et des éventuels frais bancaires que l’opération a pu engendrer, le porteur de la carte doit contester, par écrit, le prélèvement auprès de sa banque, dans les 70 jours suivant l’opération, voire 120 jours si le contrat le liant à celle-ci le prévoit. Les montants prélevés sont remboursés par la banque dans un délai maximum d’un mois après réception de la contestation écrite formée par le porteur. Aucun frais de restitution des sommes ne pourra être mis à la charge du titulaire.

La confirmation d’une commande entraîne acceptation des présentes conditions de vente, la reconnaissance d’en avoir parfaite connaissance et la renonciation à se prévaloir de ses propres conditions d’achat. L’ensemble des données fournies et la confirmation enregistrée vaudront preuve de la transaction. Si l’acheteur possède une adresse électronique et s’il l’a renseignée sur son bon de commande, le VENDEUR lui communiquera par courrier électronique la confirmation de l’enregistrement de sa commande.

Article 5. Réserve de propriété

Le VENDEUR conserve la propriété pleine et entière des produits vendus jusqu'au parfait encaissement du prix, en principal, frais et taxes compris.

Article 6. Rétractation

En vertu de l’article L121-20 du Code de la consommation, l’acheteur dispose d'un délai de quatorze jours ouvrables à compter de la livraison de leur commande pour exercer son droit de rétractation et ainsi faire retour du produit au vendeur pour échange ou remboursement sans pénalité (hors frais de retour), à l’exception notamment de certains produits fabriqués à la demande. Dans le cadre de son activité, notamment en raison du caractère sur mesure des produits achetés par le biais d’une société d’impression à la demande permettant de confectionner les articles proposés par le VENDEUR, celui-ci ne procède ni à l’échange ni au remboursement des produits. L’absence de stock et le faible nombre d’exemplaires ainsi produits ne permet pas notamment au VENDEUR de faire valoir un tel droit auprès de ses fournisseurs.

Article 7. Livraison

Les livraisons sont faites à l’adresse indiquée sur le bon de commande qui ne peut être que dans la zone géographique convenue. Les commandes sont effectuées par un ou plusieurs services de livraison avec suivi, remise sans signature. Les délais de livraison ne sont donnés qu’à titre indicatif ; si ceux-ci dépassent quarante-cinq jours à compter de la commande, le contrat de vente pourra être résilié et l’acheteur remboursé. Il est à noter que le caractère sur mesure de nos produits, utilisant des services d’entreprises partenaires spécialisées dans l’impression à la demande, implique l’absence de stock et une impression sur mesure de tous les produits proposés par le VENDEUR.

Le VENDEUR pourra fournir par e-mail à l’acheteur le numéro de suivi de son colis. L’acheteur est livré à son domicile par une société de logistique dépendant de sa localisation d’une part, et de la localisation de l’imprimerie partenaire la plus proche de sa localité d’autre part. Les risques liés au transport sont à la charge de l'acquéreur à compter du moment où les articles quittent les locaux de l’imprimerie agréée. L’acheteur est tenu de vérifier en présence du livreur l’état de l’emballage de la marchandise et son contenu à la livraison. En cas de dommage pendant le transport, toute protestation doit être effectuée auprès du transporteur dans un délai de trois jours à compter de la livraison.

Article 8. Garantie

En cas de non-conformité d’un produit vendu, il conviendra de le notifier au VENDEUR qui le reprendra, l’échangera ou le remboursera. Toutes les réclamations, demandes d’échange ou de remboursement doivent s’effectuer par mail l’adresse suivante : info@carco-watercolor.com dans un délai de trente jours après livraison.

Les éventuels retours se feront généralement directement auprès des imprimeries partenaires du VENDEUR. Il est donc important de ne rien envoyer à l’adresse postale du VENDEUR. Tant que les échanges par messagerie n’ont pas eu lieu et que le retour n’est pas officiellement acté par le VENDEUR, (émission d’un mail avec spécification des modalités de retour), tout retour ne sera pas pris en compte par le VENDEUR et sera donc effectué aux frais et risques de l’acheteur.

Article 9. Responsabilité

Le VENDEUR, dans le processus de vente à distance, n’est tenu que par une obligation de moyens. Sa responsabilité ne pourra être engagée pour un dommage résultant de l’utilisation du réseau Internet tel que perte de données, intrusion, virus, rupture du service, ou autres problèmes involontaires.

Article 10. Propriété intellectuelle

Tous les éléments du site carco-watercolor.com sont et restent la propriété intellectuelle et exclusive de la société Carco Watercolor. Personne n’est autorisé à reproduire, exploiter, ou utiliser à quelque titre que ce soit, même partiellement, des éléments du site qu’ils soient sous forme de photo, logo, impression, poster, carte, vêtement, objet, visuel ou texte (liste non-exhaustive).

Article 11. Données à caractère personnel

Le VENDEUR s'engage à préserver la confidentialité des informations fournies par l’acheteur, qu'il serait amené à transmettre pour l'utilisation de certains services. Toute information le concernant est soumise aux dispositions de la loi n° 78-17 du 6 janvier 1978. A ce titre, l'internaute dispose d'un droit d'accès, de modification et de suppression des informations le concernant. Article 12. Règlement des litiges

Les présentes conditions de vente à distance sont soumises à la loi française. Pour tous litiges ou contentieux, le Tribunal compétent sera celui de Nanterre, France.

These conditions of sale are concluded on the one hand by the company Carco Watercolor, a sole proprietorship whose registered office is located  in Chaville, registered with the Nanterre Trade and Companies Register  under number 914 908 025 RCS hereinafter referred to as the "SELLER" and managing the site carco-watercolor.com  and, on the other hand, by any natural or legal person wishing to make a purchase via the website carco-watercolor.com hereinafter referred to as "the buyer".

Article 1. Object

These conditions of sale aim to define the contractual relations between the SELLER and the buyer and the conditions applicable to any purchase made through the website carco-watercolor.com. The acquisition of a product through this site implies an unreserved acceptance by the buyer of these conditions of sale of which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site carco-watercolor.com is not directly related to his professional activity and is limited to strictly personal use and on the other hand have full legal capacity, allowing him to commit himself under these general conditions of sale.

The SELLER retains the possibility to modify these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Produce

The products offered are those listed on the carco-watercolor.com website  of the company Carco Watercolor.  The SELLER reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description containing its main technical characteristics (capacity, use, composition, etc.).  The photographs are as faithful as possible but do not bind the Seller. The sale of the products presented in the carco-watercolor.com site  is intended for all buyers residing in countries that fully authorize the entry into their territory of these products.

Article 3. Rates

The prices appearing on the product sheets of the internet catalog and are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The SELLER reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order.

Article 4. Order and terms of payment

Before any order, the buyer must create an account on the carco-watercolor.com website. The account creation section can be accessed directly from the sidebar. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile ...), must identify himself with this information. The company carco-watercolor.com offers the buyer to order and pay for its products in several stages, as follows:

- Secure payment by PayPal or credit card: the buyer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references ...), checks the delivery address or fills in a new one. Then, the shipping costs are calculated and submitted to the buyer. Then, the buyer chooses the payment method of his choice: "Payment by PayPal" or "payment by credit card". The next step offers him to fill in  and verify all the information, read and accept these general conditions of sale by ticking the corresponding box, then invites him to validate his order by clicking on the button "Confirm my order". Finally, the buyer is redirected to the secure interface PayPal in order to securely fill in his account references PayPal, or on the secure inteface of his personal credit card  . If the payment is accepted, the order is registered and the contract definitively formed. Payment by PayPal account or credit card is irrevocable. In case of fraudulent use of it, the buyer may demand the cancellation of the card payment, the sums paid will then be recredited or returned. The holder of a credit card is not liable if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain a refund of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest, in writing, the direct debit with his bank, within 70 days of the transaction, or even 120 days if the contract binding him to it provides. The amounts deducted are reimbursed by the bank within a maximum period of one month after receipt of the written dispute filed by the holder. No costs of returning the sums may becharged to the holder.

The confirmation of an order implies acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of them and the renunciation to avail oneself of its own conditions of purchase. All the data provided and the recorded confirmation will be proof of the transaction. If the buyer has an e-mail address and if he has entered it on his order form, the SELLER will communicate to him by e-mail the confirmation of the registration of his order.

Article 5. Retention of title

The SELLER retains full ownership of the products sold until full receipt of the price, in principal, including fees and taxes.

Article 6. Retraction

Under Article L121-20 of the Consumer Code, the buyerhas a period of fourteen working days from the delivery of their order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty (excluding return costs), with the exception  in particular of certainproducts manufactured on demand .  As part of its activity,  in particular because of the tailor-made nature of the products purchased through a printing company on demand to make theitems offered by the SELLER,  the latter does notallow either the exchange or the refund of the products .  The absence of stock and the small number of copies thus produced does not allow the SELLER   to assert such a right with its suppliers.

Article 7. Delivery

Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by one or more delivery  services with tracking, delivery without signature. Delivery times are given for information purposes only; if these exceed forty-five days from the order, the sales contract may be terminated and the buyer refunded.  It should be noted that the tailor-made nature of our products, using the services of partner companies specialized in print on demand, implies the absence of stock and a tailor-made printing of all the products offered by the SELLER.

The SELLER may provide the buyer with the tracking number of his package by e-mail. The buyer is delivered to his home by a logistics company dependent on hislocation on the one hand, and the location of the partner printing company closest to his locality on the other hand. The risks related to transport are the responsibility of the purchaser from the moment the items leave the premises of the approved printing house.  The buyer is obliged to check in the presence of the delivery person the condition of the packaging of the goods and its contents on delivery. In case of damage during transport, any protest must be made to the carrier within three days of delivery.

Article 8. Guarantee

In case of non-conformity of a product sold, it will be necessary to notify the SELLER who will take it back, exchange it or refund it. All complaints, requests for exchange or refund must be made by email to the following address: info@carco-watercolor.com within thirty days after delivery.

Any returns will generally be made directly to the SELLER's partner printers. It is therefore important not to send anything to the SELLER's postal address. Provided that theexchanges by courier have not taken place and that the return is not officially recorded by the SELLER, (issuance of an email with specification of the terms of retour), any return will not be taken into account by  the SELLER and will therefore  be made at the expense and risk of the buyer .

Article 9. Responsibility

The SELLER, in the process of distance selling, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, or other involuntary problems.

Article 10. Intellectual property

All elements of the carc o-watercolor.com website  are and remain the intellectual and exclusive property of Carco Watercolor.  No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, printing, poster, map, clothing, object, visual or text (non-exhaustive list).

Article 11. Personal data

The SELLER undertakes to preserve the confidentiality of the information provided by the buyer, which he would have to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the Internet user has a right to access, modify and delete information concerning him. Article 12. Dispute Resolution

These conditions of distance selling are subject to French law. For all disputes or litigation, the competent court will be that of Nanterre, France.
